TITLE OF BILL:                                                                 

                                                                               

An  act  to amend the education law, in relation to aid for small city         

school districts                                                               

                                                                               

PURPOSE OR GENERAL IDEA OF BILL:                                               

                                                                               

Modifies the formula in which aid to small city  school  districts  is         

distributed.                                                                   

                                                                               

SUMMARY OF SPECIFIC PROVISIONS:                                                

                                                                               

Section  1  of the bill amends subdivision 31-a of section 3602 of the         

education law by modifying the formula in which aid  to  small  cities         

school districts is distributed.                                               

                                                                               

Section 2 Effective Date.                                                      

                                                                               

JUSTIFICATION:                                                                 

                                                                               

Aid  to  small city school districts was instituted as a grant program         

by Chapter 288 of the Laws of 1979, and was intended to provide  funds         

to districts at or near constitutional tax limits. With the removal of         

small  city  constitutional tax limits by a referendum in 1985, aid to         

small city school districts is provided to permit  such  districts  to         

adjust  their taxes gradually to an appropriate level. This bill would         

base the distribution of aid to small city school districts  on  total         

enrollment figures.

FISCAL IMPLICATIONS:                                                           

                                                                               

No  additional  cost  to  the State. The 2001-02 State Budget provided         

$81.88 million for aid to small city  school  districts.  The  2002-03         

Executive Budget maintains this level of funding for aid to small city         

school districts.                                                              

                                                                               

EFFECTIVE DATE:

       AN ACT to amend the education law, in relation to  aid  for  small  city

         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-

       BLY, DO ENACT AS FOLLOWS:                                               

                                                                               

    1    Section 1. Subdivision 31-a of section 3602 of the  education  law  is

    2  amended by adding a new paragraph h to read as follows:                 

    3    H.  NOTWITHSTANDING  THE  PROVISIONS OF PARAGRAPHS B, C, D, F AND G OF

    4  THIS SUBDIVISION, AID PAYABLE TO SMALL CITY SCHOOL DISTRICTS FOR  SCHOOL

    5  YEARS  BEGINNING  ON  AND  AFTER JULY FIRST, TWO THOUSAND FIVE, SHALL BE

    6  COMPUTED ON A PER STUDENT  BASIS.  THE  AMOUNT  OF  SUCH  AID  SHALL  BE

    7  COMPUTED AS FOLLOWS:                                                    

    8    (I)  TAKE THE TOTAL AMOUNT OF SCHOOL AID APPORTIONED TO ALL SMALL CITY

    9  SCHOOL DISTRICTS FOR THE TWO THOUSAND  FOUR--TWO  THOUSAND  FIVE  SCHOOL

   10  YEAR;                                                                   

   11    (II)  DIVIDE  THAT AMOUNT BY THE SUM OF TOTAL ENROLLMENT FOR ALL SMALL

   12  CITY SCHOOL DISTRICTS FOR  THE  TWO  THOUSAND  TWO--TWO  THOUSAND  THREE

   13  SCHOOL YEAR;                                                            

   14    (III)  FOR  EACH  SCHOOL  DISTRICT, MULTIPLY THE NUMBER RESULTING FROM

   15  SUBPARAGRAPH (II) OF THIS PARAGRAPH BY THE  TOTAL  ENROLLMENT  FOR  SUCH

   16  SCHOOL  DISTRICT  FOR  THE CURRENT SCHOOL YEAR. THE RESULTING PRODUCT IS

   17  THE AMOUNT PAYABLE TO SUCH SCHOOL DISTRICT FOR THE CURRENT SCHOOL YEAR.

   18    FOR PURPOSES OF THIS PARAGRAPH, "TOTAL ENROLLMENT" SHALL  INCLUDE  ALL

   19  STUDENTS  IN PRE-KINDERGARTEN THROUGH GRADE TWELVE, PLUS ALL STUDENTS IN

   20  UNGRADED CLASSES FOR STUDENTS WITH DISABILITIES.
