shall direct preparation of a statewide cost of living index, and the          

percentage increase in such apportionment shall equal the percentage increase  

in cost of living for the appropriate area; also takes into account regional   

differences in population in determining cost of living increases for school   

districts.

TITLE OF BILL:  An act to amend the education law, in relation to utili-       

zation of a cost of living adjustment                                          

                                                                               

PURPOSE OR GENERAL IDEA OF BILL:  To provide for a cost of living              

increase payable to school districts as a percentage of school aid             

apportionment.                                                                 

                                                                               

SUMMARY OF SPECIFIC PROVISIONS:  This bill would amend Section 3602 of         

the education law by adding new subdivision 40, which would make a             

school district eligible for an apportionment based upon a cost of             

living adjustment utilizing a statewide index.                                 

                                                                               

JUSTIFICATION:  Aside from the current Building Aid formula, the State         

aid to education formula does not reflect the higher regional costs in         

various areas around our state. This bill, would add as a factor in            

determining State aid, regional costs of living based upon the consumer        

price index promulgated by the United States Department of Labor.              

                                                                               

Many of the built-in costs to provide quality education vary dramat-           

ically from region to region around the state reflecting regional costs.       

By computing the state aid to education formula with a cost of living          

additive, the final state aid to schools would more fairly reflect need        

for the same service aids.

       AN  ACT to amend the education law, in relation to utilization of a cost

         of living adjustment                                                  

                                                                               

         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-

       BLY, DO ENACT AS FOLLOWS:                                               

                                                                               

    1    Section  1.  Section  3602 of the education law is amended by adding a

    2  new subdivision 40 to read as follows:                                  

    3    40. COST OF LIVING ADJUSTMENT. A. IN ADDITION TO ANY OTHER  APPORTION-

    4  MENT  UNDER  THIS  SECTION,  A  SCHOOL DISTRICT SHALL BE ELIGIBLE FOR AN

    5  APPORTIONMENT BASED UPON A COST OF LIVING ADJUSTMENT UTILIZING A  STATE-

    6  WIDE  INDEX,  PREPARED  AT THE DIRECTION OF THE COMMISSIONER, OF COST OF

    7  LIVING INCREASES. SUCH ADJUSTMENT SHALL BE DETERMINED AS A PERCENTAGE OF

    8  THE APPORTIONMENT, OTHERWISE RECEIVABLE BY SUCH SCHOOL  DISTRICT,  EQUAL

    9  TO  THE  MOST  RECENT ANNUAL COST OF LIVING INCREASE FOR THE APPROPRIATE

   10  AREA EXPRESSED AS A PERCENTAGE.                                         

   11    B. IN PREPARING THE STATEWIDE INDEX, THE COMMISSIONER SHALL TAKE  INTO

   12  ACCOUNT  REGIONAL  FLUCTUATIONS  AND INCREASES IN POPULATION IN ORDER TO

   13  ENSURE THAT THE STATEWIDE INDEX ACCURATELY REFLECTS THE COST  OF  LIVING

   14  INCREASES  FOR  SCHOOL  DISTRICTS  WHICH  ARE  ATTRIBUTABLE  TO REGIONAL

   15  DIFFERENCES IN POPULATION IN ADDITION TO THE COST  OF  LIVING  INCREASES

   16  ATTRIBUTABLE TO OTHER FACTORS.                                          

   17    S  2.  This act shall take effect on the first of July next succeeding
