Provides that any mandate or requirement promulgated by the commissioner of    

education shall have no effect unless adequate funding for such mandated       

program is appropriated out of state revenues to finance the cost of

TITLE OF BILL:  An act to amend the education law, in relation to              

requiring the state legislature to fund any program mandated by the            

commissioner of education                                                      

                                                                               

PURPOSE OR GENERAL IDEA OF BILL:                                               

To ensure that no mandate of the Education Department can be                   

implemented for school years on and after the effective date of this           

act unless there is state funding provided to cover the cost to local          

school districts. Relieves the local school district from the                  

responsibility of complying with such mandates, except to the degree           

for which total state funding is provided.                                     

SUMMARY OF SPECIFIC PROVISIONS:                                                

Would add a new Subdivision 34 to Section 305 of the Education Law.            

JUSTIFICATION:                                                                 

A serious problem confronting school districts is the increasing               

financial burden associated with the mandates. The Commissioner of             

Education authorizes many programs which are not specifically                  

sanctioned by the Legislature. Hence, the Legislature is not cognizant         

of those mandates when establishing aid to education. Consequently,            

the Education Commissioner`s mandates which have the force of law,             

have to be funded totally out of the property taxes of the local               

districts.                                                                     

FISCAL IMPLICATIONS:                                                           

None, providing the Commissioner does not promulgate regulations which         

require cost upon local school districts.                                      

EFFECTIVE DATE:                                                                

The first of July next succeeding the date on which it shall have              

become a law.

       AN  ACT  to  amend the education law, in relation to requiring the state

         legislature to fund any program mandated by the commissioner of educa-

         tion                                                                  

                                                                               

         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-

       BLY, DO ENACT AS FOLLOWS:                                               

                                                                               

    1    Section  1.   Section 305 of the education law is  amended by adding a

    2  new subdivision 35 to read as follows:                                  

    3    35. ANY MANDATE OR REQUIREMENT PROMULGATED BY THE  COMMISSIONER  SHALL

    4  HAVE  NO  FORCE  OR  EFFECT UNLESS ADEQUATE FUNDING FOR SUCH MANDATED OR

    5  REQUIRED PROGRAM IS APPROPRIATED OUT OF STATE REVENUES  TO  FINANCE  THE

    6  COST  OF  IMPLEMENTING  SUCH MANDATED PROGRAM BY LOCAL SCHOOL DISTRICTS.

    7  NO LOCAL SCHOOL DISTRICT SHALL BE REQUIRED TO COMPLY WITH ANY MANDATE OR

    8  DIRECTIVE OF THE COMMISSIONER BEYOND THE EXTENT  FOR  WHICH  FULL  STATE

    9  FUNDING IS PROVIDED BY THE LEGISLATURE.                                 

   10    S  2.  This act shall take effect on the first of July next succeeding
