TITLE OF BILL:  An act to amend the education law, in relation to creat-       

ing  a  temporary  state commission to study and make recommendations on       

distribution of state aid to local school districts                            

                                                                               

PURPOSE OR GENERAL IDEA OF BILL: This bill  would  create  a  bipartisan       

commission  for the purpose of studying and reforming the state`s school       

aid formula.                                                                   

                                                                               

SUMMARY OF SPECIFIC PROVISIONS: Section 1 would add  a  section  to  the       

Education  law  to create the commission, which would be composed of two       

members of the Assembly appointed by the Speaker,  two  members  of  the       

Senate appointed by the Senate Majority Leader, one member of the Assem-       

bly  appointed by the Assembly Minority Leader, one member of the Senate       

appointed by the Senate Minority Leader, three members, one each repres-       

enting parents, labor, and school management, appointed by the governor,       

and a Chair, to be appointed jointly. Section 2 adds a  section  to  the       

education law which would describe the function of the temporary commis-       

sion,  including reviewing education financing formulae and accountabil-       

ity measures and making recommendations for ensuring  quality,  adequate       

education  for  all  students in New York State public schools, ensuring       

equity in education for all students statewide, linking funding to costs       

associated with reaching learning  standards  in  New  York,  evaluating       

current  distribution  of  funds  and  determining  districts  which are       

currently receiving insufficient state funding,  formulating  a  funding       

strategy that takes into account "at risk" students, ensuring that local       

property  taxes  do  not  affect the equitable distribution of education       

funding, and creating an accountability system for schools which are  in       

need of additional funding.                                                    

                                                                               

JUSTIFICATION: The formula for aid to local school districts in New York       

State  is overly complex, and often criticized as inequitable. This bill       

would create a bipartisan commission  to  study  the  formula  and  make       

recommendations  for  making  it fairer and more equitable, while taking       

into account the interests of  the  various  stakeholders  in  education       

funding.

       AN ACT to amend the education law, in relation to creating  a  temporary

         state  commission to study and make recommendations on distribution of

         state aid to local school districts                                   

                                                                               

         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-

       BLY, DO ENACT AS FOLLOWS:                                               

                                                                               

    1    Section 1. The education law is amended by adding a new section 141 to

    2  read as follows:                                                        

    3    S  141.  COMMISSION  ON  AID TO LOCAL SCHOOL DISTRICTS. 1. A TEMPORARY

    4  STATE COMMISSION IS HEREBY CREATED TO BE  KNOWN  AS  THE  COMMISSION  ON

    5  EDUCATION  FUNDING  FORMULA REFORM. THE COMMISSION SHALL CONSIST OF NINE

    6  MEMBERS TO BE APPOINTED  AS  FOLLOWS:  TWO  MEMBERS  SHALL  BE  SENATORS

    7  APPOINTED BY THE TEMPORARY PRESIDENT OF THE SENATE; TWO MEMBERS SHALL BE

    8  ASSEMBLY  MEMBERS  APPOINTED  BY THE SPEAKER OF THE ASSEMBLY; ONE MEMBER

    9  SHALL BE A SENATOR APPOINTED BY THE SENATE MINORITY LEADER;  ONE  MEMBER

   10  SHALL  BE  AN ASSEMBLY MEMBER APPOINTED BY THE ASSEMBLY MINORITY LEADER;

   11  AND THREE MEMBERS SHALL BE APPOINTED BY THE GOVERNOR, ONE OF WHICH SHALL

   12  BE A REPRESENTATIVE OF PARENTS OF SCHOOL CHILDREN, ONE OF WHICH SHALL BE

   13  A REPRESENTATIVE OF LABOR ORGANIZATIONS AND ONE  OF  WHICH  SHALL  BE  A

   14  REPRESENTATIVE OF SCHOOL MANAGEMENT.                                    

   15    2. A. ANY VACANCY THAT OCCURS IN THE COMMISSION SHALL BE FILLED IN THE

   16  SAME  MANNER  IN  WHICH  THE ORIGINAL APPOINTMENT WAS MADE. THE GOVERNOR

   17  SHALL DESIGNATE A CHAIR AND VICE-CHAIR OF THE COMMISSION.               

   18    B. NO MEMBER, OFFICER OR EMPLOYEE OF THE COMMISSION SHALL BE DISQUALI-

   19  FIED FROM HOLDING ANY OTHER PUBLIC OFFICE OR EMPLOYMENT, NOR SHALL HE OR

   20  SHE FORFEIT ANY SUCH OFFICE OR  EMPLOYMENT  BY  REASON  OF  HIS  OR  HER

   21  APPOINTMENT  HEREUNDER,  NOTWITHSTANDING  THE PROVISIONS OF ANY GENERAL,

   22  SPECIAL OR LOCAL LAW, ORDINANCE OR CITY CHARTER.

    1    3. THE COMMISSION SHALL MAKE A STUDY OF EXISTING DISTRIBUTION OF STATE

    2  AID TO LOCAL SCHOOL DISTRICTS AND LOCAL SCHOOL AID FORMULAS FOR FUNDING.

    3  MORE SPECIFICALLY, THE COMMISSION SHALL:                                

    4    A.  REVIEW  CURRENT  EDUCATION  FINANCING  FORMULAS AND ACCOUNTABILITY

    5  MEASURES;                                                               

    6    B. MAKE RECOMMENDATIONS FOR ENSURING QUALITY, ADEQUATE  EDUCATION  FOR

    7  ALL STUDENTS IN NEW YORK STATE PUBLIC SCHOOLS;                          

    8    C.  MAKE  RECOMMENDATIONS  FOR  ENSURING  EQUITY  IN EDUCATION FOR ALL

    9  STUDENTS IN NEW YORK STATE PUBLIC SCHOOLS;                              

   10    D. LINK FUNDING AMOUNTS TO COSTS ASSOCIATED WITH REACHING  ESTABLISHED

   11  DEPARTMENT STANDARDS;                                                   

   12    E.  EVALUATE  CURRENT  DISTRIBUTION  OF  STATE  FUNDS  AND DETERMINING

   13  DISTRICTS THAT ARE CURRENTLY RECEIVING INSUFFICIENT FUNDING;            

   14    F. STUDY AND MAKE RECOMMENDATIONS REGARDING LOCAL PROPERTY  TAXES  AND

   15  SUCH LOCAL TAXES AFFECT ON THE EQUITABLE DISTRIBUTION OF EDUCATION FUND-

   16  ING;                                                                    

   17    G.  CREATE  AN  ACCOUNTABILITY SYSTEM FOR SCHOOLS WHICH ARE IN NEED OF

   18  ADDITIONAL EDUCATION FUNDING; AND                                       

   19    H. FOR THE ACCOMPLISHMENT OF ITS PURPOSES,  THE  COMMISSION  SHALL  BE

   20  AUTHORIZED  AND  EMPOWERED  TO UNDERTAKE ANY STUDIES, INQUIRIES, SURVEYS

   21  AND ANALYSES IT MAY DEEM RELEVANT THROUGH ITS OWN PERSONNEL, OR IN COOP-

   22  ERATION WITH PUBLIC AND PRIVATE AGENCIES  INCLUDING  RESEARCH  ORGANIZA-

   23  TIONS, UNIVERSITIES, FOUNDATIONS, EDUCATIONAL AND CIVIC ORGANIZATIONS.  

   24    4.  THE  COMMISSION  MAY  EMPLOY  AND  AT PLEASURE REMOVE AN EXECUTIVE

   25  DIRECTOR, SECRETARY, COUNSEL, CONSULTANTS AND SUCH OTHER PERSONNEL AS IT

   26  MAY DEEM NECESSARY FOR THE PERFORMANCE OF ITS FUNCTIONS  AND  FIX  THEIR

   27  COMPENSATION  WITHIN  THE AMOUNTS MADE AVAILABLE BY APPROPRIATION THERE-

   28  FOR. THE COMMISSION MAY MEET WITHIN AND WITHOUT THE STATE; TAKE TESTIMO-

   29  NY, SUBPOENA WITNESSES AND REQUIRE THE PRODUCTION OF BOOKS, RECORDS  AND

   30  PAPERS;  HOLD  PUBLIC  AND  PRIVATE  HEARINGS AND OTHERWISE HAVE ALL THE

   31  POWERS OF LEGISLATIVE COMMITTEE UNDER THE LEGISLATIVE LAW.              

   32    5. THE MEMBERS OF THE COMMISSION SHALL  RECEIVE  NO  COMPENSATION  FOR

   33  THEIR  SERVICES BUT SHALL BE ALLOWED THEIR ACTUAL AND NECESSARY EXPENSES

   34  INCURRED IN THE PERFORMANCE OF THEIR DUTIES UNDER THIS SECTION.         

   35    6. THE COMMISSION MAY REQUEST AND SHALL RECEIVE FROM  ANY  DEPARTMENT,

   36  DIVISION,  BOARD, BUREAU, COMMISSION OR AGENCY OF THE STATE OR ANY POLI-

   37  TICAL SUBDIVISION THEREOF SUCH ASSISTANCE AND DATA  AS  WILL  ENABLE  IT

   38  PROPERLY TO CARRY OUT ITS POWERS AND DUTIES UNDER THIS SECTION.         

   39    7.  THE COMMISSION IS HEREBY AUTHORIZED AND EMPOWERED TO MAKE AND SIGN

   40  ANY AGREEMENTS, AND TO DO AND PERFORM ANY ACTS THAT  MAY  BE  NECESSARY,

   41  DESIRABLE  OR  PROPER  TO  CARRY OUT THE PURPOSES AND OBJECTIVES OF THIS

   42  ACT.                                                                    

   43    8. THE COMMISSION SHALL FROM TIME TO TIME MAKE A REPORT OR REPORTS  TO

   44  THE  GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE, THE SPEAKER OF THE

   45  ASSEMBLY AND THE COMMISSIONER. IT SHALL, NOT LATER THAN FEBRUARY  FIRST,

   46  TWO  THOUSAND SIX, MAKE AN INTERIM REPORT TO THE GOVERNOR, THE TEMPORARY

   47  PRESIDENT OF THE SENATE, THE SPEAKER OF THE ASSEMBLY AND THE COMMISSION-

   48  ER OF EDUCATION, AND NOT LATER THAN FEBRUARY FIRST, TWO THOUSAND  SEVEN,

   49  A  FINAL  REPORT TO THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE,

   50  THE SPEAKER OF THE ASSEMBLY AND THE COMMISSIONER OF ITS STUDIES, TOGETH-

   51  ER WITH ITS RECOMMENDATIONS PURSUANT TO THIS SECTION.                   

   52    9.  THE  COMMISSION  SHALL   CONTINUE   IN   EXISTENCE   UNTIL   MARCH

   53  THIRTY-FIRST, TWO THOUSAND SEVEN.                                       

   54    10.  FOR PURPOSES OF THIS SECTION, "COMMISSION" SHALL MEAN THE COMMIS-

   55  SION ON EDUCATION FUNDING FORMULA REFORM ESTABLISHED IN THIS SECTION.
